PROJECT DESCRIPTION
Griffin's client required environmental due diligence services prior to the potential purchase of a 70-year old industrial property in South Haven, MI. Griffin's investigation identified chlorinated solvents in the subsurface soils underneath the site building as a result of the historical industrial activities conducted between the 1950s and 2020s. Given the levels of contaminated soils identified by Griffin, a building vapor intrusion issue was identified that required mitigation to protect building occupants and provide the client with due care compliance. Griffin assisted Pro Team Commercial with negotiating down the purchase price of the site, as well as providing costs for design and installation of a vapor mitigation system to address vapor intrusion issues, and future Operations & Maintenance (O&M) activities, in order to meet the client's due care obligations.

CHALLENGES
Project challenges included providing a timely technical solution to the building vapor intrusion issue, while concurrently providing financial modeling for system design, installation, and future O&M to allow for the client to adjust their project pro forma and purchase agreement. Additionally, once the client and seller had agreed to the revised purchase agreement, Griffin needed to implement the design and installation tasks in short order so as to not affect the client's ability to begin building retrofit and leasing activities to meet their Return On Investment (ROI) goals.
SOLUTIONS PROVIDED
Solutions provided by Griffin to meet the client's project goals included conducting all environmental due diligence activities which included a Phase I ESA, a Phase II ESA with subsequent rounds of soil vapor delineation, preparation of a Baseline Env. Assessment (BEA) to provide the client with env. liability protection against the existing contamination, and assembling a Documentation of Due Care Compliance (DDCC) report to demonstrate due care and protecting building occupants. Additionally, Griffin managed the design and installation of the vapor mitigation system (VMS) in the building, and conducted subsequent O&M activities to maintain the VMS.
RESULTS
Griffin's assistance with the purchase agreement negotiations resulted in Pro Team Commercial realizing over $100,000 in savings that hit the bottom line as well as providing for additional soil vapor investigation, VMS design, installation, and future O&M activities. Environmental liability protection was achieved for Pro Team Commercial via completion of the BEA and DDCC reports. Pro Team Commercial closed on the property, conducted targeted build-outs for several new tenants, and achieved due care compliance protecting their building occupants with the installation of the VMS.
